Punishment for kidnapping Whoever kidnaps any person from India or from lawful guardianship, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine. [Chapter 16: kidnapping, abduction, slavery and forced labour]

Example: A person who kidnaps any person from India or from lawful guardianship, may be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine. In a real FIR or trial, investigators must show that the facts match the ingredients of the offence (intent, act, and other elements as applicable) under Section 363.
